Terms and Conditions of Service
Effective Date: 05/04/2025

1. Introduction 

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("the Client", "you" or "your") and P3 United Pty Ltd (ABN: 86 654 808 661) ("P3 United", "we", "us" or "our") concerning the provision of professional development, career coaching, and related advisory services ("the Services"). By engaging our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use or access our Services.

2. Scope of Services

P3 United provides non-clinical, non-therapeutic, professional advisory and coaching services, including but not limited to: 

  • Career and Life Coaching
  • Leadership Development Coaching
  • Resume and Cover Letter Writing
  • Interview Preparation and Role-Playing
  • Mindset and Motivation Support

 All services are delivered either virtually, via telephone, or in person (subject to availability), and are tailored on a case-by-case basis according to the individual Client's needs.We do not provide legal, medical, financial, or psychological advice. Clients requiring such services are advised to consult with the appropriate professionals.

3. Bookings and Payment Terms 

3.1 Booking Confirmation: Services must be booked in advance via our online platform, email, or direct arrangement. Bookings are subject to availability. 

3.2 Payment: Payment for Services must be made in full at the time of booking, unless otherwise agreed in writing. Fees are quoted in Australian Dollars (AUD) and inclusive of Goods and Services Tax (GST) where applicable. 

3.3 Late or Non-Payment: Failure to make payment by the agreed due date may result in cancellation of services. P3 United reserves the right to recover outstanding fees through debt recovery processes, including third-party collection agencies, and the Client shall be liable for any associated costs. 

3.4 Price Changes: P3 United reserves the right to revise its pricing at any time. Price changes will not affect confirmed bookings.

4. Cancellations, Rescheduling and Refund Policy 

4.1 Client-Initiated Cancellations: Cancellations made more than 24 hours prior to the scheduled service time may be eligible for rescheduling or a full refund. Cancellations made within 24 hours may result in forfeiture of the session fee.

4.2 No-Shows: If the Client fails to attend a scheduled session without prior notice, the full session fee will be forfeited. 

4.3 Provider Cancellations: In the event that P3 United must cancel a session, the Client will be offered a rescheduled appointment or a full refund.

4.4 Change of Mind: Refunds will not be issued for change-of-mind cancellations once the service has commenced or been delivered. 

4.5 Australian Consumer Law Compliance: This policy is in accordance with the guarantees and protections provided under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL).

5. Disclaimer and Limitation of Liability 

5.1 General Disclaimer: While every effort is made to provide accurate, relevant, and up-to-date information, P3 United does not warrant or guarantee specific outcomes, including but not limited to job acquisition, promotion, or career advancement. 

5.2 Limitation of Liability: To the fullest extent permitted by law, P3 United shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or in connection with the use of our Services, whether based on contract, tort (including negligence), equity or otherwise. 

5.3 Maximum Liability: Where liability cannot be excluded, P3 United’s total aggregate liability for any claim related to the Services is limited to the amount paid by the Client for the specific service to which the claim relates.

6. Intellectual Property 

6.1 All intellectual property, including but not limited to course materials, worksheets, guides, videos, written content, and other resources provided by P3 United, remains the exclusive property of P3 United. 

6.2 Clients are granted a non-exclusive, non-transferable, revocable license to use such materials for personal, non-commercial use only. 

6.3 Any reproduction, distribution, public display, or modification of our materials without our express written permission constitutes a breach of these Terms and may result in legal action.

7. Confidentiality and Privacy 

7.1 P3 United will take reasonable steps to ensure that all personal and sensitive information shared by the Client is kept confidential in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. 

7.2 We will not disclose your personal information to third parties unless required to do so by law or with your express written consent.

8. Client Responsibilities 

8.1 The Client agrees to provide accurate, current, and complete information to facilitate effective service delivery. 

8.2 The Client acknowledges that results depend on their own participation, engagement, and application of strategies discussed during the sessions. 

8.3 Clients agree to conduct themselves professionally and respectfully during all interactions.

9. Consumer Guarantees 

Nothing in these Terms is intended to exclude, restrict, or modify any guarantees, warranties, rights or remedies conferred on the Client by the Australian Consumer Law or any other applicable legislation.

10. Amendments 

P3 United reserves the right to modify these Terms at any time. Continued use of the Services after changes are made constitutes acceptance of the revised Terms. The latest version of these Terms will be published on our website.

11. Governing Law and Jurisdiction 

These Terms shall be governed by and construed in accordance with the laws of the Australian Capital Territory, and the parties irrevocably submit to the exclusive jurisdiction of the courts of that state.
